In the prime of life, Mr. Thelsey L. Fuller nor Mrs. Edwina J. Fuller would have allowed or stood for anyone swindling them out of their assets.

I may not be in the prime of life but, I'm not going to stand for the TRUST being swindled anymore than it has already.

And a couple of sweet ladies will not keep getting the shaft!

Not on my watch!

SO, HELP ME GOD!

A holiday lesson: One young N.J. athlete's devotion to his sick mother

Over the past few months, with little feeling from the waist down and barely able to move, she developed potentially fatal bedsores. The wound on her sacral bone — the "butt bone" — is diagnosed as stage four, the most severe. She has more sores on her legs and hips.

Vitale, her doctor, says Vaida’s greatest danger is developing an infection. That means Quai’s most important job as her primary caregiver — cleaning and bandaging the wounds twice a day — is most crucial to Vaida’s survival.

"You can’t underestimate what taking care of those ulcers is doing for her," Vitale says. "Some people pass out by the smell. They pay nurses big money to do stuff like that."
quai-vaida-hands.JPGMother and son have an unbreakable connection: "God gave me a wonderful angel," Vaida Jefferson says. "œShe'™s truly my heart, my rock, my stone," Quai says. "Like, that'™s all I have."

The sores look like craters in her flesh, Quai says, with exposed bone, muscle and tissue. Wearing gloves and holding his breath, he removes the old dressings, gently cleans the wounds, applies prescription ointment and bandages them.

"You wouldn’t wish that upon your worst enemy," Quai says. "To see a loved one have to go through that is just dreadful."

Support legislation to allow for videocams

California State Senator Bob Huff is considering introducing a bill in California, like the recently enacted Oklahoma law, that would confirm the right to have videocams in residential care facilities (RCFEs) and skilled nursing facilities (SNFs) for people who want the protection it can provide. Sadly, while many facilities provide good care, there have been abuses and instances of very poor care. Having videocams that families can monitor and that facility management can use for monitoring and quality improvement would help eliminate these incidents.

What are the benefits of videocams? One good example is an RCFE named Vista Gardens Memory Care, in San Diego County in the town of Vista, which was built with cameras installed for the protection of the residents who want video monitoring. If there is any question about whether a staff person has misbehaved, Vista Gardens could find out if it occurred and correct it immediately. If a patient has bruises one morning, Vista Gardens could review the video recording to see that the bruises occurred, for example, when the patient fell out of bed reaching for a night table. The solution is to move the night table closer to the bed. If the resident is found on the floor with a bruise on the head, Vista Gardens could review the video of the resident falling and relay pertinent information to paramedics or the ER for treatment decisions. Also, if a hallucinating resident were to claim that something improper occurred (e.g., a lady claiming a naked man was in her room), Vista Gardens could review the video to ascertain that it did not happen.

Unfortunately, the California Department of Social Services’ Community Care Licensing Division (CCLD) and the Department Health Services (DHS), acting as a proxy for the California Association of Health Facilities (CAHF), have told Vista Gardens Memory Care that they may not conduct video recording in the rooms or allow anyone to conduct any video recording in the residents' rooms, even if the resident fervently wants the monitoring. CCLD and DHS have prohibited video cameras in Vista Gardens Memory Care, even though residents or the residents’ health care agents have given written consent for the video cameras and really want the video monitoring for their own protection. In addition, CCLD and DHS have prohibited the video cameras, even though there is no California law prohibiting video cameras in residents’ rooms, where there is a reasonable expectation of privacy only for the residents, who can waive their right to privacy to allow the video monitoring.

We believe that confirming the right to have videocam monitoring with the proper resident consents and privacy safeguards would greatly enhance protection for residents of nursing homes and RCFEs, and serve as a strong deterrent to harmful behavior.

Please help us get this bill launched by sending a fax to Senator Bob Huff at (916) 651-4929, or calling his Sacramento office at (916) 651-4029. You can send Sen. Huff a short email through this URL. Tell him, “I support a bill that would allow videocam monitoring with the proper resident consents and privacy safeguards, like the recently enacted bi-partisan Oklahoma law, to prevent elder abuse.”

Please also let us know if you have sent a message to Sen. Huff.

Thank you for your support and help!

Keep knocking them out!

"In welterweight action, Kevin Watts of Los Angeles scored a second round knockout over Alejandro Arteaga in a scheduled four round bout. Watts boxed well behind the jab using his distance in round one. A crunching left hook to the body sent Arteaga to the canvas as referee Lou More reached a ten count at 1:26 of the second round. With the win Kevin Watts improves to 3-0, 2 KOs. Alejandro Arteaga falls to 3-8, 1 KO."

Elder Abuse: None are spared

Elder abuse: Deaf, retired Mattydale man loses $105,000 to 'friends' repaid

Ray Gratzer, 78, of Mattydale, poses with his final repayment check outside County Court today. He is joined by Assistant District Attorney Beth Van Doren. Two people were convicted of stealing $105,000 from him in a case of elder abuse.(Douglass Dowty | ddowty@syracuse.com)

‘Elder abuse’ charged
RUSSELLVILLE — A Colbert County woman already in jail on traffic and drug-related charges now is accused of bilking several thousands of dollars from an elderly Russellville man, police said Friday.

Russellville Police Chief Chris Hargett said Jennifer Ann Lunsford, 41, 1565 Choctaw St., Cherokee, is charged with financial exploitation of an elderly person.

Holidays time to check for elder abuse
The holiday season offers a chance to reconnect with older family members and friends. Most reunions can be filled with joy. But some may leave you filled with concern.

If an elderly relative, friend or acquaintance doesn't look or act right, they may need help. There may be numerous causes for their condition, but in some cases you may have to think the unthinkable -- they may be a victim of elder abuse.

"If their physical appearance has changed in any way, if they've lost a lot of weight, seem somewhat more confused or something suddenly has changed in their financial circumstances, those types of things are red flags," says Donna Dougherty, attorney in charge of JASA's legal services for the elderly. JASA, an acronym for Jewish Association Serving the Aging, is a Manhattan-based, not-for-profit organization that provides social services, legal advice and nutrition services for seniors in the metropolitan area.

Deposition, Testimony of Mr. Thelsey L. Fuller

There is no deposition or testimony by Thelsey L. Fuller.  He wasn't even allowed to be present during mediation. He was not deposed and he was not called to the witness stand.

Steven A. Fuller and Sandra Jones Anderson had 15 months to place the man whom they were suing on the witness stand which they failed to perform.

It is alleged that Atty. Anderson and Atty. Lak drug the case out in order to inflate their attorney fees.

Continuance, continuance, continuance, after continuance ruled the day.

For over an entire year, Mr. Thelsey L. Fuller was never allowed to be asked or answer one question on the record regarding his wife - Mrs. Edwina J. Fuller, his desires, his children or his assets.

The fact that Thelsey L. Fuller and Odessa Gaines did not act as a married couple and instead maintained separate bedrooms over the entire course of their relationship is not part of any testimony.

But, instead the claims by Robert and Doris of a husband wife relationship between the pair.  I suggest that they were roommates and very close friends that looked out for one another.

Daddy came and went as he pleased, seeing other women including his wife.

Robert and Doris have not paid the bond as required in regards their appeal.

California Community Property Laws, Family Law section 760. “Except as otherwise provided by statute, all property, real or personal, wherever situated, acquired by a married person during the marriage while domiciled in this state is community property” and again, Probate Code Section 100-103 clearly provides that assets acquired during the course of a marriage are presumed to be community unless proven to be separate by the one claiming separate property."

It is not like our parents were married briefly, they were married for 72 years. The Court had within its power to immediately restrain the assets and by doing so would have protected the Conservatee and the Respondent from financial elder abuse.

Thelsey L. Fuller and Edwina J. Fuller were never divorced or legally separated and no evidence has been presented otherwise.

The lack of a restraining order left both parents vulnerable to elder abuse, financial elder abuse, fiduciary abuse, conspiracy, theft and fraud; which is exactly what took place.

Attorney Daniel k. Lak had refused to give the Conservatee, Edwina Fuller, Thelsey L. Fuller’s 92 year old widow, a copy of her husband’s Trust when requested in writing until so ordered by the Court. These actions are in direct violation of Probate Code Section 16061.7 and may be in violation of elder abuse laws under Welfare and Institutions Code, Section 15610.30 as well.

The Supreme Court has ruled and has reaffirmed the principle that "justice must satisfy the appearance of justice", Levine v. United States, 362 U.S. 610, 80 S.Ct. 1038 (1960), citing Offutt v. United States, 348 U.S. 11, 14, 75 S.Ct. 11, 13 (1954); again Courts have repeatedly held that positive proof of the partiality of a judge is not a requirement, only the appearance of partiality. Liljeberg v. Health Services Acquisition Corp., 486 U.S. 847, 108 S.Ct. 2194 (1988) (what matters is not the reality of bias or prejudice but its appearance); United States v. Balistrieri, 779 F.2d 1191 (7th Cir. 1985; (2) mitigate the damages caused by the Court by issuing a Court order to protect the remaining assets; (3) the Court has within its power to order funds that were removed before the Court could rule on them, be brought back and deposited with the Court along with any penalties; (4) issue an injunction that would prevent the further transfer of real property to another party until a ruling is made by the Court; and (5) launch an investigation into the improper actions of Attorney Daniel K. Lak, Robert L. Fuller, Doris A. Fuller Stewart.

Elder abuse, elder abuse, elder abuse...

Elder Abuse the Focus of a New Site That Shines Spotlight on Silent Epidemic
The new Elder-Abuse.net offers help and resources to victims of elder abuse.

The statistics regarding the rate of elder abuse in America are astounding. According to the National Center on Elder Abuse, there were nearly six million cases of elderly abuse in 2010 in the United States alone. The stats suggest that nearly a whopping 10 percent of the entire American elderly population reported a form of abuse, and many instances of abuse go unreported altogether.

The newly-launched site Elder-Abuse.net is shining the spotlight on elder abuse in the United States and offering victims hundreds of helpful resources.

“Too many times cases of abuse of senior citizens go unreported due to fear of retaliation or further abuse,” said Elder-Abuse.net spokesperson Gene Stillman. “The numbers show that commonality of elder abuse is out of control and on the verge of becoming a silent epidemic in America today.”

One of the more frightening statistics to come out of the study conducted by the National Center on Elder Abuse says that an astounding 68 percent of all elder abuse cases were perpetrated by family members. Stillman says that fact makes instances of elder abuse even tougher to report.

BP099211, BP122665 -- B241450, From where I sit, PART II

http://benamarine.blogspot.com part of court record.

Introduced by defendant's attorney, Daniel K. Lak, case BP135381

Case No. BP 135381; ABUSERS OBJECTIONS

JULY 06, 2009, BOTH GRANDPARENTS WERE ALIVE.

Robert lied in his testimony concerning many issues but, one lie that he told that sticks out immediately came just as soon as he took the witness stand is when he stated having one child. In reality Robert has four children all daughters. Lynn, Lenora, Lynette and Laconia from his first wife Linda whom he murdered.

He married Banessa Coleman after he was released from prison for said murder. During his marriage to Banessa he also had relationships with at least two other women.

Sandra Pritchard Smith and Barbara Powell.

Barbara Powell would become his third wife and they stayed together until Barbara was arrested and convicted for murder.  The child that he claimed as his own during his testimony is actually Barbara's daughter, Yolanda Butler.

Robert's natural children do not have a relationship with him which he blamed on Edwina and Steven not that he murder their mother.

Robert was also accused of rape [he robbed her] in 1961 but, was acquitted.

Robert is known by the street name, "Buddha" and has a history of street violence, is known to have shot his first wife's brother and cousin.  He assaulted and slashed a co-worker with a knife.

He also has a history of woman beating.  He beat Linda on several occasions, stomping her with steel-toed boots, kicking her down stairs and dragging her by the hair.

Banessa was a church going woman he beat her and cheated on her with several other women, two of which were mentioned earlier, he left Banessa for Barbara. Banessa later died from a broken heart.

Barbara wouldn't stand for the beatings, set their apartment on fire and later during the relationship shot it out with Robert from her mother's house as he was shooting at her from across the street [Wilmington & 122nd St, Compton].  That marriage ended when Barbara was convicted and sentenced for killing a neighborhood crack dealer that they owed money too.

-------------

Doris should have been born a man, she believes that she can do what ever a man can do only better.

She has always been involved with drugs and drug dealers.

On one occasion about the same time that she purchased the Bradfield property she had to go to Thelsey to borrow money to keep some drug dealer from killing her.

Roger Grant the father of one of her children
was murdered when he couldn't come up with the drug money that he left in Doris's care while he was behind bars and which she spent. I wrote James Hawkins Jr. where he is currently housed and he maintained that he did not murder Roger Grant but, did acknowledge d that Grant was a snitch for the police.

Doris went to Thelsey in 2007 and asked him for money.  He offered her $42,000.00 and told her it was her inheritance.  She turned it down and told him that it wasn't enough.

Neither Robert or Doris would do anything for Thelsey unless he paid them even after he was giving them thousands of dollars each month when he lived alone. My grandfather complained to me that they wouldn't even come to see him.  I talked with my grandfather almost on a daily basis.  So, I asked him why he gave them money if they treated him in that way.  He said because he had it.  So, I told him not to do it anymore and he stopped.  Which is exactly how I knew which banking records would be relevant in this case as Robert and Doris threatened me when they thought I was coming to California not for a visit per my grandfather's request but, their belief that I was coming home to take care of him.  No way in hell would they have been able to dog out my grandfather as they did had I been there. They probably would have killed me or me them.

My grandfather never wanted to be placed in a convalescent hospital and that was always his stance. He damn sure didn't want to get robbed. When I sent the sheriff to Doris's home to check on his well being they refused to disclose his whereabouts. Three weeks later he was dead.

-------------

I believe that Daniel K. Lak never represented Thelsey L. Fuller, that was never the plan.

BP099211, BP122665 -- B241450, From where I sit, PART I

The family knew that someone was going to need to take care of Mr. Thelsey L. Fuller when he was living alone and came home from the hospital to an empty house saying that he had come home to die.

The family never suspected that their parents would become the victims of elder abuse, financial elder abuse, fraud, theft and undue influence by other members of the family.

Robert and Doris are not Thelsey's children. Robert's father was Anglo. Robert is the seed of a rapist. Edwina is not Doris's birth mother. Edwina left Doris at the hospital, she believed that her actual daughter was switched at the hospital at birth.  The rape and the switching of her baby were contributing factors to Edwina's mental illness.

Immediately after removing Thelsey from the home of Steven and Edwina, Daniel Lak being hired by Appellants, the Thelsey S. Fuller (sic) Trust was created and then the amendment. After which time Robert and Doris isolated Thelsey from all other family members. No other family members save Robert and Doris were privy to the Trust document until order by the Court upon Thelsey’s death. Thelsey’s original will  [prior to any Trust document] is believed to have been destroyed by Robert and or Doris.

It must be noted that Mr. Thelsey L. Fuller was a sickly 90-year-old man that was docile, compliant and in the beginning stages of diminished capacity.

Carol and Thelsey attempted to place the Belhaven property into Carol’s name without Edwina’s consent.

Also, Robert when told that if anything happened to Edwina everything would go to Thelsey but, if anything happened to Thelsey everything would go to Edwina.

Robert said, that is not how it’s going down, that’s not how is going to be or words to that effect.

Robert and Michael Long were like father and son, brothers, confidants and friends for 48 years -- until Robert became hostile toward him as Robert took over Thelsey’s assets.

Having enjoyed a very close relationship, love and constant contact with his grandfather, Thelsey L. Fuller and the love and care of his grandmother, Edwina J. Fuller, after learning from Thelsey that he had tried to put the Belhaven property into Carol’s name and the conflict with Robert over property that belonged to Thelsey and Edwina… Michael Long then advised Steven to move to protect Edwina’s interest in the marital assets.

Steven filed PC 850 on 05/12/2008 allegedly for that purpose.

Robert and Doris filed their response to the PC 850 five months later on 10/30/2008 and long after it should have been filed in accordance with law. And long after they had Mr. Thesley L. Fuller allegedly sign off on all of the paperwork that they needed him to sign. FORGERY? The Trust, the Trust Amendment, Power of Attorney over his bank accounts, real estate deeds and gifts of real estate. Robert and Doris had everything they needed, they took his retirement money and his social security checks each and every month.  The only thing they hadn't taken was all of his money that came later.

Mr. Thelsey L. Fuller was never allowed to make any statement or give any testimony in open court or in mediation to be asked and answer any questions as to his own desires for his wife or his children.

1. Thelsey Fuller, left because Edwina put him out. He and Odessa Gaines were roommates they maintained separate bedrooms over the course of their entire relationship. Thelsey saw other women. Thelsey never divorced his wife, Edwina. Died in 2009.

3c.   The 12th Avenue property was transferred from Odessa to Thelsey via a quit claim deed facilitated by Thelsey, Robert, and Carol, notarized by Bernice Dunlap [Thelsey’s granddaughter, Robert’s neice, Carol’s daughter].  This was done to prevent “Bonnie,” Odessa’s niece from claiming a 50% interest in the 12th Avenue property upon Odessa’s death.

D. Michael Long, grandson. Mr. Long’s very last conversation with Thelsey was to advise him not
to trust anyone to which he responded, “I know.”  Mr. Long called the L. A. County Sheriff Dept. to go to Doris’s home once and one time only.

Re: Location and condition of Mr. Thelsey L. Fuller, 92-years-old unknown on 08 August 2009. Deputy Anderson at approximately 9:20 PM (EST), Incident #170, File #14014. All other contacts with authorities by Mr. Long have been to attempt to have the pair arrested and charged with criminal elder abuse, criminal financial elder abuse, fraud, theft and undue influence.

On 07/01/2009, Robert L. Fuller and Doris A. Fuller withdraw $235,152.28.  One month later Mr. Thelsey L. Fuller is placed in a convalescent hospital against his will. On 08/05/2009 Robert Fuller notifies the staff that Mr. Fuller suffers diminished capacity. "Resident has fluctuating capacity to understand and make decisions." When it suited their interest from the witness stand [Robert & Doris] Mr. Fuller was mentally competent. All of Robert and Doris’s actions in regards to Mr. Thelsey L. Fuller are classic signs of elder abuse, financial elder abuse, fraud, theft and undue influence.

E. Steven Fuller filed PC 850 on the Inglewood property on 05/12/2008 but, didn't ask the court to
freeze any assets belonging to consignee’s husband until 06/30/2009 over a full year later from filling the PC 850.  Upon learning that Steven Fuller was asking for the court to freeze the assets, Robert and Doris Fuller immediately removed $239,752.28 from one of Thelsey’s bank accounts.  Also, Mr. Thelsey L. Fuller had more than one bank account.

Fiona Cherrie notarized several questionable documents “Thelsey S. Fuller” (sic), which are alleged to have been signed by Mr. Thelsey L. Fuller -- a very sickly 92-year-old man. These documents were prepared at least sixty days after Mr. Thelsey L. Fuller would have been notified of the PC 850. No objections being filed by Robert, Doris or their attorney, Daniel K. Lak until five months later.

The Trust did not include the Belhaven property but, the Bradfield property [Doris’s house, reverse mortgage, gifted to her by Thelsey] and Thelsey’s “portion” of the Inglewood property instead. Though someone decided to included the language that Thelsey “is not currently married” Thelsey claimed only a portion of the Inglewood property which tends to indicate that he as reserving a portion to his wife, Mrs. Edwina J. Fuller. The Belhaven property is not mentioned in the Trust but was placed in the Trust by Robert, Doris and their attorney Daniel K. Lak. [United States District Court, District of Nevada, Case No.:2:09-cv-00686-RLH-LRL "Town & Country Bank, Plaintiff vs. Brian Goodard and Daniel K. Lak, Defendants]

Less than thirty days after removing Thelsey’s money from the bank, Mr. Thelsey L. Fuller was placed in a convalescent hospital against his will by Robert and Doris Fuller where he was abandoned.  Suffering from anemia, malnutrition, multiple pressure ulcers of various stages, and dehydration at the hands of his so called ‘care givers” Mr. Thelsey L. Fuller was enrolled in Medi-cal, abandon at the convalescent hospital and left to die alone and broke.

No one mentions the condo in Playa Del Rey. Lak has a history of slandering real estate titles and not filing paper work.

Thelsey L. Fuller would have never abandoned his family and Thelsey was still seeing his wife, Edwina after they separated.  Thelsey beat Edwina’s friend, Mr. Cluster to a bloody heap…

Robert is a murderer.

Robert did crack and Doris snorted cocaine.

Robert holds himself out as being retired from the County of L. A. when he didn't actually work but, was on disability from the job for at least 15 years if not more.

Robert and Doris had Thelsey in their care for a little over a year it cost him his life. Along the way they made damn sure no one was able to see or speak to him alone.

Steven took care of Edwina for over 20 years, she was just as sick as Thelsey, possibly more so but she was cared for and lived another 2 years and 10 months after her husbands death.

If you want to know the truth, ask me.
