Plot to remove Atty. Patrick J Barnitt as Successor Trustee


It is alleged that Steven A. Fuller and Atty. Teddie J. Randall engaged in activities and actions in order to remove Atty. Patrick J. Barnitt as Successor Trustee long before Atty. Barnitt decided to resign.

It was over a full year that Fuller and Randall decided that Atty. Barnitt should be removed.

Obviously, Atty. Barnitt as the Successor Trustee was not moving fast enough to facilitate the illegal sale of the real estate assets belonging to the Thelsey L. Fuller Trust.

Where Atty. Barnitt went astray was in agreeing to sell the Trust 50% interest in 1916 below fair market value and that my friends is when the State Bar of California was notified via a complaint against attorneys.

Once the complaint was filed and Atty. Barnitt was notified of its content then and only then did he desire to resign as Successor Trustee.

So, now Steven A. Fuller is in need of another Successor Trustee that will rubber stamp his designs for the Thelsey L. Fuller Trust and why he sought out Atty. Tala R. Davis an attorney with ties to Atty. Teddie J. Randall.

And this my friends is why Steven A. Fuller has not been able to sell the real estate asset located at 8625 which belongs to the Trust nor close escrow on 1916.

It must be noted that Atty. Jonnie Hilda Johnson-Parker turned them down.

Petnr alleges that on 4/14/14, petnr was advised by Jeanne Fitzgerald, atty for Patrick Barnitt, that her client had resigned as succr tee and she would no longer serve as his attorney.

Petnr alleges that on 4/3/14, the trust sold its one-half interest in R/P located at 1916 North Belhaven Avenue, Los Angeles, by Court confirmation (the other one-half interest is owned by the Estate of Edwina Fuller was sold separately). Petnr alleges escrow is waiting to close on each interest and a succr tee must be appointed to address the pending escrow and other trust matters.

State Quickly Dismissed Elder-Abuse Cases, Investigation RevealsState regulators have been conducting "cursory and indifferent" investigations of complaints against caregivers for the elderly, disabled and sick, even when those cases involve suspected abuse or suspicious death, according to an investigation by the Center for Investigative Reporting and KQED. Documents obtained by CIR also reveal the California Department of Public Health dismissed nearly 1,000 pending cases of abuse and theft over the past decade, when the state was dealing with a backlog of cases.

FULLER VS. FULLER ET AL. - APPEAL CONTINUED... AGAIN


Over a 15 month period and before his death Mr. Thelsey L. Fuller was never placed under oath asked or answered any question in regards to any civil case by the Plaintiff, Steven A. Fuller or Plaintiff's Attorney, Atty. Sandra Jones Anderson.

Atty. Daniel Kristof Lak for respondent, Mr. Thelsey L. Fuller never placed his client on the stand or under oath during a deposition either being that everything that need to be allegedly signed by Mr. Thelsey L. Fuller had been signed and put into place before Atty. Lak responded to the court case.

Bottom line, neither party wanted Mr. Thelsey L. Fuller on the witness stand.  What would he have said?

"Stick it to my daughters, Carol and Sandra."?

LOS ANGELES (AP) - A judge on Monday ordered an investigation into the whereabouts of Casey Kasem after an attorney for the ailing radio personality's wife said the former "Top 40" host had been removed from the country.

Los Angeles Superior Court Judge Daniel S. Murphy ordered a court investigator and adult protective services to find out where Kasem is being treated and report back to the court. Kasem, 82, suffers from advanced Parkinson's disease, can no longer speak and has been in various medical facilities chosen by his wife, Jean Kasem.

Casey Kasem's children have complained that they have been unable to see their father in accordance with an agreement with their stepmother. Daughter Kerri Kasem had sought a temporary conservatorship and was appointed her father's temporary caretaker on Monday. Her attorney, Troy Martin, said the family believes the entertainer has been taken to an Indian reservation in Washington state.

Murphy's order came after Craig Marcus, an attorney who appeared on Jean Kasem's behalf at Monday's hearing, said he did not know where the radio personality was but knew that he had been removed from the country.

Conspiracy to sell Trust Assets below fair market value


It is alleged that Patrick J. Barnitt and Jeanne M. Fitzgerald as Successor Trustee and Attorney for Successor Trustee colluded and conspired with Steven A. Fuller to sell the Thelsey L. Fuller Trust real estate assets and to circumvent the appeal pending before the 2nd Appeal Court.

The Trust fifty-percent interest in the single-family residence, 1916 N. Belhaven Ave, is $150,000.00 the valuation of which is based on a good faith estimate pursuant to Probate Code section 1063(a).

The fifty-percent interest of the Estate of Edwina Fuller was offered up for sale by Steven A. Fuller, theTrust fifty-percent interest was offered up for sell by Jeanne M. Fitzgerald and confirmed sold by the Court for $76,000.00.  Prior to the sale Steven A. Fuller, Patrick J. Barnitt and Jeanne M. Fitzgerald were notified that if the assets were to be sold they needed to be sold for fair market value to prevent a financial loss to the Thelsey L. Fuller Trust and the Estate of Edwina Fuller.

The actions of Patrick J. Barnitt, Jeanne M. Fitzgerald and Steven A. Fuller in the selling of the fifty-percent interest of the Trust asset and the fifty-percent interest of the Estate of Edwina Fuller in the property noted above for far below fair market value is financial elder abuse and against the beneficiaries of the Thelsey L. Fuller Trust and the Estate of Edwina Fuller i.e. Shirley, Sandra, Robert and Doris.

It is alleged that the Trust properties, 1916 N. Belhaven Ave and 8625 S. 12th Ave were marketed in order to spite Robert Fuller & Doris Fuller and to deprive them of the Trust assets if they prevailed on appeal, the Belhaven Ave property having been sold [below fair market value] while the appeal by the defendants  is still pending before the court.

It is also alleged that Patrick J. Barnitt converted $600.00 from monies paid to evict; to administrative fees. Barnitt was paid the sum of $600.00 to evict the occupant(s) from the Trust real estate located at 8625 S. 12th Ave, Inglewood, CA.

See page 2 of the DECLARATION OF PATRICK J. BARNITT (1) RESIGNATION AS TRUSTEE; AND (2) REQUEST OF TRUSTEE FOR EXPENDITURES dated 03/27/14.

As of this writing the only services to the Thelsey L. Fuller Trust that Mr. Barnitt has performed is the sale of the Trust's 50% interest in the Belhaven asset [below fair market value] and the attempted sale of the Inglewood asset [below fair market value] at the request of Steven Fuller and in total disregard and circumvention of the wishes of the beneficiaries to the Thelsey L. Fuller Trust and to their detriment.

It is therefore further alleged that the attorneys, Patrick J. Barnitt & Jeanne M. Fitzgerald engaged in a conflict of interest in carrying out the sinister designs of Steven A. Fuller in regards to the Thelsey L. Fuller Trust in the selling and attempted selling of the Trust real estate assets below market value.

Atty. Teddie J. Randall was notified far in advance by his clients, Arnold's Attorney-in-Fact and Ritchey that they were opposed to the Trust assets being sold below fair market value.  Atty. Randall instead catered to the nefarious designs of Steven A. Fuller in the selling of the Trust asset, a blatant conflict of interest in regards to Arnold & Ritchey.

Thelsey's $1,000.00 per month to each, save one


Mr. Thelsey L. Fuller was giving his adult children $1,000.00 per month prior to October 2007, SAVE ONE.

From my communication with him over the telephone he related that he was giving them $1,000.00 each except for Steven A. Fuller.

Steven A. Fuller was receiving the total sum of ZERO.  Hm?

I asked him why he did it at the time because he was complaining that when ever he needed help they expected to be paid.

I asked him why he did it and he told me because he had it.

So, I told him not to do it anymore and he cut them off.

That would have been about the same time that he had asked me if I were ever coming home and I told him that since he asked, "No." That conversation would have been around Thanksgiving 2007. I then had a blow up with the family.

It is through the relationship that I had with my grandfather that Steven A. Fuller through David Lewin, LASC BP118616 was able to determine which bank records would be relevant in the court cases moving through Los Angles Superior Court.

When my declaration was made Mr. Thelsey L. Fuller was still alive.


Also, I find it odd that Steven A. Fuller nor his attorney, Sandra Jones Anderson, SBN #93456 found it necessary to place Mr. Thelsey L. Fuller on the witness stand for 15 month but, instead before Atty. Anderson did anything in regards to the court cases found it necessary to to place liens on Mr. Thelsey L. Fuller's real estate.

Mr. Thelsey L. Fuller was never asked or answered any question by either party's attorney, Sandra Jones Anderson for the plaintiff - Steven A. Fuller; Daniel K. Lak for the defendants. Mr. Thelsey L. Fuller was never placed under oath and asked what he wanted.  Litigants had 15 months to take advantage of the opportunity to do just that but, failed to do so.  Hmm?

It must be noted that in my opinion Steven A. Fuller is far worse than Robert and Doris.  Steven is a wolf in sheep's clothing and he doesn't care who he bites in the ass.

The family knew or had every reason to believe that Mr. Thelsey L. Fuller's real estate assets would be required to be sold in order to satisfy Steven A. Fuller's attorneys' lust for MONEY! 

We never imagined that Steven A. Fuller and the various attorneys that he had contact with in the several cases would collude and conspire in order to sell Thelsey L. Fuller's Trust assets far below fair market value - a blatant case of FINANCIAL ELDER ABUSE against Steven A. Fuller's siblings [Shirley, Sandra, Robert & Doris].  The reason we believe that the Belhaven Ave. property was sold below fair market value was in order to speed up the selling of the asset thus depriving Robert and Doris their 50% interest in the asset should they prevail on appeal.

Steven A. Fuller has even gone so far as to threaten, intimidate, coerce, manipulate and deceive his two sisters, Shirley & Sandra into signing documents against their will in order for Attorney Teddie J. Randall to attach his attorney fees to the Trust. Yeah, he and his attorney Mr. Randall knowing full well that they were informed of Ms. Arnold's Attorney-In-Fact in regards to the court cases and the Thelsey L. Fuller Trust.

Steven A. Fuller is currently in the process of attempting to have an attorney with ties to Teddie J. Randall's office to be appointed by the court as Successor Trustee in order to complete his sinister designs on Mr. Thelsey L. Fuller's Trust assets.

Formal complaints have been lodged against several attorneys in the court cases.  Attorney Teddie J. Randall has also been compliant with and in agreement with the desires of Steven A. Fuller in direct conflict with the directions and concerns of his other clients in the Trust matter, Shirley and Sandra [selling of the Trust asset below fair market value].   Teddie Randall has attached his attorney fees to the Trust vs. going after the defendants for payment as order by the court.

A complaint against Partick J. Barnitt with the California State Bar, we believe prevented the Inglewood asset from being sold far below fair market value and Mr. Barnitt's desire to resign as Successor Trustee.

As of this writing a formal complaint of elder abuse, financial elder abuse has been lodged against Steven A. Fuller with Los Angeles County Adult Protective Services [don't hold your breath].

Mr. Thelsey L. Fuller would have never disinherited Shirley or Sandra, the same can not be said of Steven A. Fuller.

Steven A. Fuller doesn't care who he stabs in the back, after all he sued his alleged father and colluded with the various attorneys to sell Thelsey L. Fuller's Trust assets below fair market value.  We believe that makes him far worse than the defendants.

If anyone wants to know the truth all they need do is ask.

ARGUMENT: Objr is 75 y.o. and has been permanently disabled since 1999; diagnosed with lupus in 1998. Objr currently resides in the subject r/p. Objr alleges she was allowed to live rent-free on the r/p with the consent of her parents. In 7/03, she began paying rent of 300/mo; rent was used for decd's care. Objr paid rent on a regular basis until 7/12. Objs to sale of r/p; argues that it is premature bc debts and expenses of admin have yet to be fully determined. Consorshp proceedings have not yet terminated, so the interest in the r/p remains titled in name of consorshp. Thus, petnr is not in a position to sell the interest in the r/p. Petnr as consor obtained a judgment against Thelsey Fuller in amount of 107,692.30; the order is on appeal. Acct in consorshp was continued from 7/16/13 to 12/2/13 in D-11.
