STEVEN FULLER aka Steven Bain vs THELSEY FULLER


Steven Fuller aka Steven Bain various Court Sases in regards to his alleged dad, Thelsey Fuller.

If we would have known then what we know now, Steven would have not be able to savage the family and destroy everything that our parents worked their entire lives to accomplish. 

He definitely would not have been able to take advantage of his victims in all of this, namely: Thelsey L. Fuller; Edwina J. Fuller; Shirley C. Ritchey; and Sandra J. Arnold.

It must be noted that Steven had designs on selling real estate that did not belong to him but, instead that which belonged to his victims, Thelsey L. Fuller & Edwina J. Fuller.

Simply put, Steven voiced his desires to sell all of the real estate assets while Dad was still living alone in Inglewood.

We didn't realize at the time how he would be able to pull it off but, he did it. Selling one of the homes well below fair market value for a $40,000.00 loss.

But, that my friends is not how the fuckry began or ended this thing has had a lot of twist and turn yet at the end of the day the snake has been exposed.

Know that it is the author's personal opinion that Steven A. is a self-righteous prick, a liar and a thief.

We await the Courts decision as Steven A. with the help of Atty. Teddie J. Randall took over $131,000.00 from the Estate of Edwina Fuller and sold real estate below fair market value.... a violation of his fiduciary duties to the estate and its beneficiaries.

Oh, he also shafted his first attorney, Sandra J. Anderson ESQ, he still owes her in excess of $14,000.00.

Steven A. Fuller's attorneys are in blue.

They were brought on board as a result of the actions of Steven A. Fuller in order to obtain MONEY! from his mother, Edwina J. Fuller and his step-father Thelsey L. Fuller.

Steven A. Fuller had 15 months to depose or have Thelsey L. Fuller placed on the witness-stand which he and his attorney, Sandra Jones Anderson at the time, failed to perform.

It must be noted that Steven A. Fuller desired and attempted to remove Atty. Tala R. Davis as Successor Trustee of the Thelsey L. Fuller Trust because she wouldn't do what he wanted her to do.

Atty. Barnitt and Atty. Fitzgerald assisted in the selling of 1916 N. Belhaven Ave below fair market value while Atty. Barnitt was the Successor Trustee. 

That Steven A. Fuller consulted with Atty. Randall on how to remove Atty. Barnitt being that he was not moving fast enough to sell 8625 S. 12th Ave below far market value.


















That was thwarted by a complaint against Atty. Barnitt and Atty. Fitzgerald with the California State Bar.

A complaint with the California State Bar has been filed against Teddie J. Randall for his actions, in-actions and omissions. 

The real estate was sold that the various attorneys of Steven Fuller AKA Steven A. Fuller could be paid and so that Steven A. Fuller could realize a pecuniary advantage over his siblings.

$107.692.30 belonging to the Estate of Edwina J. Fuller has not been accounted for by Steven A. Fuller or his attorney, Teddie J. Randall.

Madam Trustee,

This is to inform you that there is a conflict of interest between you, Atty. Teddie J. Randall and the beneficiaries of the Thelsey L. Fuller Trust.

As you know I have made it abundantly clear that there is an ongoing complaint against Atty. Teddie J. Randall with the State Bar of California - Inquiry #14-18164.

Before you were named Successor Trustee it was made known to Atty. Teddie J. Randall and Mr. Steven Fuller that your appointment as Successor Trustee was opposed because of your ties to Atty. Teddie J.Randall, his office and the pending complaint against him with the Bar.

Now, some of your actions have been to the detriment of the Trust and the Trust beneficiaries.

The beneficiaries were not given adequate time to inventory the contents of the former Trust asset located at 8625 S. 12th Ave.

But, instead the antiques and the contents were removed from the residence without being appraised, inventoried and or sorted through by the Trust beneficiaries. 

Also, you are billing the Trust as an attorney at $350.00 per hour instead of the standard $150.00 per hour as a trustee. You are seeking over $21,000.00 in compensation for administration of the Trust thus far, which is overly excessive. 

Furthermore, the beneficiaries believe that you are using the proceeds from the sale of the Trust assets as an avenue to enrich yourself and or as retaliation for the complaint filed with the Bar against Atty. Teddie J. Randall.

The beneficiaries have agreed and have previously asked that you close out the Trust to prevent the further siphoning off of the sale proceeds from the Trust assets by you and or anyone else, which you refuse to perform but, make excuses instead.

Therefore, it is requested that you render your resignation immediately.

Re: Disposition of Remaining Trust Estate

Madam Successor Trustee,

In accordance with the provisions of the Thelsey S. Fuller (sic) Trust:

Section 5.3 Disposition of Remaining Trust Estate:

"5.3 Disposition of Remaining Trust Estate.  On the settlor’s death, the remaining trust estate shall be disposed as follows:

(a) If any of the children of the settlor survive him, the trustee shall divide the trust property into as many shares of equal market value as are necessary to create one share for each of the settlor’s children who survive him and one share for each of the settlor’s children who predecease him but who leave issue surviving him.  The trustee shall distribute one share OUTRIGHT to each of the settlor’s surviving children."

Therefore, distribute immediately to the beneficiaries their shares of the trust i.e. the proceeds from the sale of the Trust real estate assets.

Madam Trustee,

Again, according to the Trust document the Trust assets were to be distributed to the Trust beneficiaries "outright" upon the Settlor's death, that did not happen.

As you know the Trust asset located at 1916 N. Belhaven Ave. was ordered sold by Court order, no such order was given by the Court in relation to 8625 S. 12th Ave.

How is it that you came to list and sell the Trust asset known as 8625 S. 12th Ave. Inglewood, CA. without the consent or input of the Trust beneficiaries let alone the fact that you have refused to carry out the wishes of the Trust Settlor, Mr. Thelsey L. Fuller (deceased)?

But, instead you appear and is alleged that you have carried out the designs of yourself, Atty. Teddie Randall and Mr. Steven Fuller*, which is in direct opposition and conflict with the wishes of the Settlor, Mr. Thelsey L. Fuller and the Trust beneficiaries.

Simply put, by what authority were you authorized to sell the Trust asset known as 8625 S. 12th Ave.?

It is noted that you continue to fail to respond to telephone calls, emails and faxes in connection with the several request that have been made to you in regards to the Trust.

The Trust was not designed so that you or anyone else could enrich yourselves to the detriment of the Trust  or its beneficiaries.

*It is known among the beneficiaries that it was always Steven Fuller's desire to sell the Trust assets and that is exactly what transpired.

First off, had Mr. Thelsey L. Fuller been placed on the witness stand these cases would have been over a very long time ago and all of the attorneys involved would have collected a whole lot less in attorney fees.

There is no deposition or testimony by Thelsey L. Fuller.  

He was not deposed and he was not called to the witness stand.

He wasn't even allowed to be present during mediation.

Steven A. Fuller and Sandra Jones Anderson had 15 months to place the man whom they were suing on the witness stand which they failed to perform.

It is alleged that Atty. Anderson and Atty. Lak drug the case out in order to inflate their attorney fees.

Continuance, continuance, continuance, after continuance ruled the day.




LIES! Perjury of Steven A. Fuller

Background

Steven purchased a home at 4004 Degnan Blvd, Los Angeles on 06/12/2007 for $625,000.00

Within the next six months immediately after purchasing the home mentioned above, Steven Fuller was faced with foreclosure and the immediate need for increased revenue/income.


Selling the home $100,000.00 below fair market value, an act of financial elder abuse, is just the tip of the iceberg.

Now he is demanding $125,000.00 for something that he volunteered to do and something that mother never agreed too.  

Yeah, dude wants to be rewarded via the civil action in L.A. Superior Court case BP 099211 et al. petitioning the Court to reward him for his fuck ups.

What he won't do is admit to the things that he did wrong in financially abusing his elderly siblings.

He coerced and intimidated his sisters in order for his friends er, attorneys, to get rich






It is alleged that Patrick J. Barnitt and Jeanne M. Fitzgerald as Successor Trustee and Attorney for Successor Trustee colluded and conspired with Steven A. Fuller to sell the Thelsey L. Fuller Trust real estate assets and to circumvent the appeal pending before the 2nd Appeal Court.

The Trust fifty-percent interest in the single-family residence, 1916 N. Belhaven Ave, is $150,000.00 the valuation of which is based on a good faith estimate pursuant to Probate Code section 1063(a).

The fifty-percent interest of the Estate of Edwina Fuller was offered up for sale by Steven A. Fuller, theTrust fifty-percent interest was offered up for sell by Jeanne M. Fitzgerald and confirmed sold by the Court for $76,000.00.  Prior to the sale Steven A. Fuller, Patrick J. Barnitt and Jeanne M. Fitzgerald were notified that if the assets were to be sold they needed to be sold for fair market value to prevent a financial loss to the Thelsey L. Fuller Trust and the Estate of Edwina Fuller.

The actions of Patrick J. Barnitt, Jeanne M. Fitzgerald and Steven A. Fuller in the selling of the fifty-percent interest of the Trust asset and the fifty-percent interest of the Estate of Edwina Fuller in the property noted above for far below fair market value is financial elder abuse and against the beneficiaries of the Thelsey L. Fuller Trust and the Estate of Edwina Fuller i.e. Shirley, Sandra, Robert and Doris.





In the very last conversation that I had with Mr. Thelsey L. Fuller, my maternal grandfather [the victim of elder abuse, financial elder abuse this blog is dedicated too], a mere twenty or so days before his death, I advised him not to trust anyone and his response was, "I know."

That said, I knew at an early age that there was a serious case of dysfunction in the family which is one of the reasons that I decided to leave California in 1990 and never to return for any reason.

Now, Steven Fuller has always attempted to portray himself as an upstanding person but, I knew from past experience that he had what I believed to be several issues. I believe him to be arrogant, egotistical, spoiled, narcissistic, conceited and self-absorbed.

Steven did take care of Momma without a doubt but, let me be clear everyone in the family believed that he did so on a voluntary basis. Truth be told, evidently he didn't. From what I understand, from what I believe and from what has come to fruition in reality is he took care of Momma for financial gain. As far as I know the only member of the family that has agreed that he should be reimbursed for some of his expenses is my mother.

He demanded money from Mr. Thelsey L. Fuller for taking care of Momma and when he didn't get it he sued him.

Let me make a very strong point, before Daddy had fallen ill and still able to live on his own, Steven's goal was always to sale real estate that was not his own but, instead that which belonged to his alleged father and mother.

After the death of both parents he was successful in the sale of the Trust real estate asset in Compton, CA [far below fair market value].  But, he failed or should I say he was thwarted in the sale of the Trust real estate asset located in Inglewood when a complaint was filed against his hand-picked Successor Trustee - Patrick J. Barnitt and Barnitt's attorney - Jeanne M. Fitzgerald with the California State Bar. It should be noted that it was believed that Barnitt was not looking out for the best interest of the Trust or the beneficiaries thereof but, instead doing the bidding of Steven A. Fuller when the Trust assets were being offered up for sale far below fair market value.  Mr. Barnitt and his attorney, Ms. Fitzgerald were advised and admonished that several beneficiaries did not want the Compton asset confirmed and sold far below fair market value but, relisted instead at fair market value if it had to be sold. The sale went through anyway. The asset was sold to pay debts incurred by Steven Fuller in pursuit of his lawsuit against the man that put a roof over his head, fed, clothed and raised him.  I believe this was done to spite Robert and Doris and to liquidate the assets before the appeal B241450 was heard in the 2nd Appellate Court. Not to be left unmentioned the fact that one of the very first things that attorney Sandra Jones Anderson [Steven's attorney] did was place a lien on the Belhaven property.





Amazing that it took 60 years to learn the whole truth about my family.

Estate Asset Should Not Have Been Sold


It would appear that now is the time to have the Court rescind the sell of 1916 N. Belhaven Ave and relist it at "FAIR MARKET VALUE" if it has to be sold in order to pay various attorney fees of Steven A. Fuller.

6. Failed to collect attorney fees from Robert & Doris in a timely manner as ordered by the Court

7. Went after the Estate of Thelsey L. Fuller two and a half years later for attorney fees.

8. Failed to disclose all documents in the case to client, full and complete copies and disclosures.

9. Conflict of interest.


Steven A. Fuller with the help of attorneys Barnitt & Fitzgerald sold a trust real estate asset below fair market value which constitutes financial elder abuse.

Petnr alleges that on 4/3/14, the trust sold its one-half interest in R/P located at 1916 North Belhaven Avenue, Los Angeles, by Court confirmation (the other one-half interest is owned by the Estate of Edwina Fuller was sold separately). More likely than not, Steven would have been disinherited and his assets would have been divided equally amongst his other children.
