Re: REAL ESTATE FRAUD COMPLAINT

Dear Los Angeles County District Attorney,

I am filling a formal real estate fraud complaint against Atty. Daniel K. Lak, Robert L. Fuller and Doris A. Fuller in regards to the real estate that appears to be owned by my late maternal grandparents, Mr. Thelsey L. Fuller and Mrs. Edwina J. Fuller prior to their deaths.

Daniel K. Lak represents Robert L. Fuller and Doris A. Fuller in several civil cases moving through the California court system in Los Angeles County.

Defendant’s Robert L. Fuller and Doris A. Fuller, LASC BP 099 211, LASC BP 122 665, were found to have committed fraud, undue influence and financial elder abuse on Mr. Thelsey L. Fuller before his death.  

Daniel K. Lak has represented Robert L. Fuller and Doris A. Fuller in the real estate fraud that I believe took place as contained and outlined herein.

It is my belief that my late grandfather, Mr. Thelsey L. Fuller, holds or may have held interest in several real estate properties located in Los Angles County, California.  I believe and have every reason to believe that his real estate property has been manipulated, slandered and hidden from the Court, Atty. Patrick Barnitt - Successor Trustee of the Thelsey L. Fuller Trust and its heirs.

Daniel K. Lak has a history of slandering real estate titles and was a defendant in a Cook County Federal Court case which was filed in Cook County, Nevada on 03/10/2009.  Daniel K. Lak has a history of not filling all of his paper work and or filling it in a timely manner.  Daniel K. Lak has uttered, published and made false malicious statements in the past in connection to real estate transactions as is this case.

Mr. Steven A. Fuller in his capacity as the Conservator of Mrs. Edwina J. Fuller filed a petition, LASC BP 099 211, asking the Court to determine the Conservatees interest in the real estate located at 8625 S. 12th Ave. owned by her husband, Mr. Thelsey L. Fuller, which was filed with the Court on 05/12/2008.

Daniel K. Lak, Robert L. Fuller and Doris A. Fuller only responded to the PC 850 after Mr. Thelsey L. Fuller signed all of the documents he needed to sign in order for Robert L. Fuller and Doris A. Fuller to take full control over their victims assets.

Only after Mr. Thelsey L. Fuller granted power of attorney over his bank accounts, signed Trusts, signed off on and gifted real estate did the suspects file their objection with the Court as to the PC 850 petition on 8625 S. 12th Ave.  At that time Mr. Thelsey L. Fuller was then isolated from all other family members. 

My grandfather’s Trust does not list the real estate located at 8707 Falmouth Ave. #308 nor the real estate located at 1916 N. Belhaven Ave. but, instead list the real estate located at 16219 S. Bradfield Ave. and his portion of the real estate located at 8625 S. 12th Ave.  

It must be noted that the Trust was created with a fictitious name, Thelsey S. (sic) Fuller.  My grandfather’s legal name is Mr. Thelsey Leo Fuller.  

Also, according to the Trust document Mr. Thelsey L. Fuller appears to have reserved the other interest in the real estate located at 8625 S. 12th Ave. to his wife, Mrs. Edwina J. Fuller.

No one has been able to explain how my grandfather came to be listed on the real estate located at 8707 Falmouth Ave. #308.  

No one has been able to explain how on 10/21/2008 as recorded my grandfather gifted Doris A. Fuller, the real estate located at 16219 S. Bradfield Ave. after she took out a reverse mortgage five months prior on 05/01/2008 in the amount of $541,000.00. 

As to the real estate located at 8625 S. 12th Ave., defendants, Robert L. Fuller and Doris A. Fuller have violated the orders of the Court.  The defendants were order to turn over all Trust Assets to the Successor Trustee but instead have taken possession of the real estate and the persons now residing therein will have to be evicted at a substantial cost to my late grandfather’s Estate.

It is my belief that the real estate property located at 1916 N. Belhaven Ave. had it’s titled slander, as the “Joint Tenancy” was broken.  The suspects recorded the property as belonging to the "Thelsey L. Fuller Trust."

My grandfather, Mr. Thelsey Leo Fuller along with his Citibank accounts also had accounts with Wells Fargo Bank which are not mentioned in the Trust.  His social security checks and his retirement electronic deposits into one of his Citibank accounts over the 15-month period prior to his death are unaccounted for.  

The suspects, Robert L. Fuller and or Doris A. Fuller removed approximately $4,600.00 on 06/30/2009 and approximately $236,752.28 on 07/01/2009 for a TWO-DAY TOTAL of $241,352.28 when the Court failed to place a restraining order on Mr. Thelsey L. Fuller’s accounts at Citibank.  From what I’ve seen of my grandfather’s checking account with Citibank, I am convinced that in excess of $308,000.00 was stolen from the victims.  Mr. Thelsey L. Fuller and Mrs. Edwina J. Fuller.

I believe with all my heart and all my soul that both of my grandparents were, are victims of elder abuse, financial elder abuse which was visited upon them by Daniel K. Lak, Robert L. Fuller and Doris A. Fuller in order that the suspects could realize a pecuniary advantage over their victims and their victims’ heirs.

Just because the victims have died – Mr.Thelsey L. Fuller and Mrs. Edwina J. Fuller – does not mean that their abusers... Robert L. Fuller, Doris. A. Fuller and Daniel K. Lak should not be brought to Justice.
