Re: REAL ESTATE FRAUD COMPLAINT

Dear Los Angeles County District Attorney,

I am filling a formal real estate fraud complaint against Atty. Daniel K. Lak, Robert L. Fuller and Doris A. Fuller in regards to the real estate that appears to be owned by my late maternal grandparents, Mr. Thelsey L. Fuller and Mrs. Edwina J. Fuller prior to their deaths.

Daniel K. Lak represents Robert L. Fuller and Doris A. Fuller in several civil cases moving through the California court system in Los Angeles County.

Defendant’s Robert L. Fuller and Doris A. Fuller, LASC BP 099 211, LASC BP 122 665, were found to have committed fraud, undue influence and financial elder abuse on Mr. Thelsey L. Fuller before his death.

Daniel K. Lak has represented Robert L. Fuller and Doris A. Fuller in the real estate fraud that I believe took place as contained and outlined herein.

It is my belief that my late grandfather, Mr. Thelsey L. Fuller, holds or may have held interest in several real estate properties located in Los Angles County, California.  I believe and have every reason to believe that his real estate property has been manipulated, slandered and hidden from the Court, Atty. Patrick Barnitt - Successor Trustee of the Thelsey L. Fuller Trust and its heirs.

Daniel K. Lak has a history of slandering real estate titles and was a defendant in a Cook County Federal Court case which was filed in Cook County, Nevada on 03/10/2009.  Daniel K. Lak has a history of not filling all of his paper work and or filling it in a timely manner.  Daniel K. Lak has uttered, published and made false malicious statements in the past in connection to real estate transactions as is this case.

Mr. Steven A. Fuller in his capacity as the Conservator of Mrs. Edwina J. Fuller filed a petition, LASC BP 099 211, asking the Court to determine the Conservatees interest in the real estate located at 8625 S. 12th Ave. owned by her husband, Mr. Thelsey L. Fuller, which was filed with the Court on 05/12/2008.

Daniel K. Lak, Robert L. Fuller and Doris A. Fuller only responded to the PC 850 after Mr. Thelsey L. Fuller signed all of the documents he needed to sign in order for Robert L. Fuller and Doris A. Fuller to take full control over their victims assets.

Only after Mr. Thelsey L. Fuller granted power of attorney over his bank accounts, signed Trusts, signed off on and gifted real estate did the suspects file their objection with the Court as to the PC 850 petition on 8625 S. 12th Ave.  At that time Mr. Thelsey L. Fuller was then isolated from all other family members.

My grandfather’s Trust does not list the real estate located at 8707 Falmouth Ave. #308 nor the real estate located at 1916 N. Belhaven Ave. but, instead list the real estate located at 16219 S. Bradfield Ave. and his portion of the real estate located at 8625 S. 12th Ave.

It must be noted that the Trust was created with a fictitious name, Thelsey S. (sic) Fuller.  My grandfather’s legal name is Mr. Thelsey Leo Fuller.

Also, according to the Trust document Mr. Thelsey L. Fuller appears to have reserved the other interest in the real estate located at 8625 S. 12th Ave. to his wife, Mrs. Edwina J. Fuller.

No one has been able to explain how my grandfather came to be listed on the real estate located at 8707 Falmouth Ave. #308.

No one has been able to explain how on 10/21/2008 as recorded my grandfather gifted Doris A. Fuller, the real estate located at 16219 S. Bradfield Ave. after she took out a reverse mortgage five months prior on 05/01/2008 in the amount of $541,000.00.

As to the real estate located at 8625 S. 12th Ave., defendants, Robert L. Fuller and Doris A. Fuller have violated the orders of the Court.  The defendants were order to turn over all Trust Assets to the Successor Trustee but instead have taken possession of the real estate and the persons now residing therein will have to be evicted at a substantial cost to my late grandfather’s Estate.

It is my belief that the real estate property located at 1916 N. Belhaven Ave. had it’s titled slander, as the “Joint Tenancy” was broken.  The suspects recorded the property as belonging to the "Thelsey L. Fuller Trust."

My grandfather, Mr. Thelsey Leo Fuller along with his Citibank accounts also had accounts with Wells Fargo Bank which are not mentioned in the Trust.  His social security checks and his retirement electronic deposits into one of his Citibank accounts over the 15-month period prior to his death are unaccounted for.

The suspects, Robert L. Fuller and or Doris A. Fuller removed approximately $4,600.00 on 06/30/2009 and approximately $236,752.28 on 07/01/2009 for a TWO-DAY TOTAL of $241,352.28 when the Court failed to place a restraining order on Mr. Thelsey L. Fuller’s accounts at Citibank.  From what I’ve seen of my grandfather’s checking account with Citibank, I am convinced that in excess of $308,000.00 was stolen from the victims.  Mr. Thelsey L. Fuller and Mrs. Edwina J. Fuller.

I believe with all my heart and all my soul that both of my grandparents were, are victims of elder abuse, financial elder abuse which was visited upon them by Daniel K. Lak, Robert L. Fuller and Doris A. Fuller in order that the suspects could realize a pecuniary advantage over their victims and their victims’ heirs.

Just because the victims have died – Mr.Thelsey L. Fuller and Mrs. Edwina J. Fuller – does not mean that their abusers... Robert L. Fuller, Doris. A. Fuller and Daniel K. Lak should not be brought to Justice.

Re: Thelsey L. Fuller Trust – Conflict of Interest, Please Resign

Madam Trustee,

This is to inform you that there is a conflict of interest between you, Atty. Teddie J. Randall and the beneficiaries of the Thelsey L. Fuller Trust.

As you know I have made it abundantly clear that there is an ongoing complaint against Atty. Teddie J. Randall with the State Bar of California - Inquiry #14-18164.

Before you were named Successor Trustee it was made known to Atty. Teddie J. Randall and Mr. Steven Fuller that your appointment as Successor Trustee was opposed because of your ties to Atty. Teddie J.Randall, his office and the pending complaint against him with the Bar.

Now, some of your actions have been to the detriment of the Trust and the Trust beneficiaries.

The beneficiaries were not given adequate time to inventory the contents of the former Trust asset located at 8625 S. 12th Ave.

But, instead the antiques and the contents were removed from the residence without being appraised, inventoried and or sorted through by the Trust beneficiaries.

Also, you are billing the Trust as an attorney at $350.00 per hour instead of the standard $150.00 per hour as a trustee. You are seeking over $21,000.00 in compensation for administration of the Trust thus far, which is overly excessive.

Furthermore, the beneficiaries believe that you are using the proceeds from the sale of the Trust assets as an avenue to enrich yourself and or as retaliation for the complaint filed with the Bar against Atty. Teddie J. Randall.

The beneficiaries have agreed and have previously asked that you close out the Trust to prevent the further siphoning off of the sale proceeds from the Trust assets by you and or anyone else, which you refuse to perform but, make excuses instead.

Therefore, it is requested that you render your resignation immediately.

Re: Disposition of Remaining Trust Estate

Madam Successor Trustee,

In accordance with the provisions of the Thelsey S. Fuller (sic) Trust:

Section 5.3 Disposition of Remaining Trust Estate:

"5.3 Disposition of Remaining Trust Estate.  On the settlor’s death, the remaining trust estate shall be disposed as follows:

(a) If any of the children of the settlor survive him, the trustee shall divide the trust property into as many shares of equal market value as are necessary to create one share for each of the settlor’s children who survive him and one share for each of the settlor’s children who predecease him but who leave issue surviving him.  The trustee shall distribute one share OUTRIGHT to each of the settlor’s surviving children."

Therefore, distribute immediately to the beneficiaries their shares of the trust i.e. the proceeds from the sale of the Trust real estate assets.

* * * * * * * * * * * * * * * * * * * * * * * *
Madam Trustee,

Again, according to the Trust document the Trust assets were to be distributed to the Trust beneficiaries "outright" upon the Settlor's death, that did not happen.

As you know the Trust asset located at 1916 N. Belhaven Ave. was ordered sold by Court order, no such order was given by the Court in relation to 8625 S. 12th Ave.

How is it that you came to list and sell the Trust asset known as 8625 S. 12th Ave. Inglewood, CA. without the consent or input of the Trust beneficiaries let alone the fact that you have refused to carry out the wishes of the Trust Settlor, Mr. Thelsey L. Fuller (deceased)?

But, instead you appear and is alleged that you have carried out the designs of yourself, Atty. Teddie Randall and Mr. Steven Fuller*, which is in direct opposition and conflict with the wishes of the Settlor, Mr. Thelsey L. Fuller and the Trust beneficiaries.

Simply put, by what authority were you authorized to sell the Trust asset known as 8625 S. 12th Ave.?

It is noted that you continue to fail to respond to telephone calls, emails and faxes in connection with the several request that have been made to you in regards to the Trust.

The Trust was not designed so that you or anyone else could enrich yourselves to the detriment of the Trust  or its beneficiaries.

*It is known among the beneficiaries that it was always Steven Fuller's desire to sell the Trust assets and that is exactly what transpired.

LASC BP 122665 - Violation of the Court Order a good thing

http://www.lasuperiorcourt.org/civilcasesummarynet/ui/?CT=CI
BP122665 [BP099211 & BP135381]

That the Trust real estate asset located in Inglewood was not turned over to Patrick J. Barnitt, Successor Trustee [& Jeanne M. Fitzgerald, Steven Fuller by extension] is a good thing.

Otherwise, the asset would have been sold far below fair market value as what happened with the Trust real estate asset located in Compton.

That Doris's daughter, Ijnanya, has been living in the Trust asset without paying rent for over two-and-a half years; while the daughter of Thelsey L. Fuller & Edwina J. Fuller has been paying rent to live in the Trust asset located in Compton many more years is a travesty.

Doris and Robert were ordered by the court to turn over all Trust assets but, being that they didn't follow the orders of the court and turnover control of the Inglewood property... the property was saved from certain sell at the hands of Steven Fuller and his cohorts.

Whether or not Ijnanya resided in the property located in Inglewood and allegedly protected the property and paid the utilities is irrelevant. Someone, be it Doris, Robert or Ijnanya or even the Successor Trustee - Patrick J. Barnitt should be on the hook for the rent that should have been paid and collected from the occupant(s). [Protecting the Trust from financial loss]

Patrick J. Barnitt as the Successor Trusttee was paid to have Ijnanya evicted but, instead took the MONEY! for that purpose and converted it, claiming the funds as "administrative fees" for the administration of the Trust. As of this writing we are unaware of any services to the Trust that Mr. Barnitt has performed in regards to the Trust of Thelsey L. Fuller other than the sale of the Trust's 50% interest in the Belhaven asset [far below fair market value] and the attempted sale of the Inglewood asset at the request of Steven Fuller and in total disregard and circumvention of the wishes of the beneficiaries to the Thelsey L. Fuller Trust.

It must be noted that over a period of 15 months no one saw fit to put Mr. Thelsey L. Fuller on the witness stand for his input as to the resolution of HIS ASSETS.

Someone needs to be held accountable.

The authorities always want the help of the public, a cooperating witness [until they get it].

COMPLAINT AGAINST SUCCESSOR TRUSTEE

15 January 2014

Office of the Chief Trial Counsel Intake
STATE BAR OF CALIFORNIA
1149 South Hill Street
Los Angeles, California 90015-2299

COMPLAINT AGAINST ATTORNEY(S)

Dear Office of the Chief Trial Counsel, Intake

Attorney Patrick John Barnitt - #94794 was appointed Successor Trustee of the Thelsey L. Fuller Trust (Trust) in the Superior Court of California, County of Los Angeles, Case BP 122 665 on March 07, 2012.  Mr. Barnitt hired attorney Jeanne Marie Fitzgerald - #134526 as Attorney for Trustee.

Mr. Barnitt has failed to properly carry out his fiduciary duties as Successor Trustee in regards to the THELSEY S. FULLER TRUST (sic), THELSY L. FULLER TRUST (Trust), dated July 23, 2008.

Mr. Barnitt has failed in his fiduciary duties to the Trust in failing to protect the Trust from monetary loss and by offering the Trust’s real estate assets for sale far below fair market value and without the prior consent or consultation with ALL of the Trust beneficiaries.

If the sale of 1916 N. Belhaven Ave., Los Angeles, CA. 90059 is confirmed by the Court at $153,000.00, the Trust will have lost $100,000.00.  Homes in the area are being sold for $250,000.00 - $300,000.00 on average.

The Trust’s real estate asset known as 8625 S. 12th Ave, Inglewood, is also set to be sold at a loss to the Trust in the amount of $100,000.00, the current asking price is $249,000.00.  The homes in that area list from $350,000.00 - $450,000.00 on average.

Combined these proposed actions [IF TAKEN] by the Successor Trustee and the Attorney for Trustee will cause a loss to the Trust conservatively at $100,000.00.  That the Trust’s real estate assets were offered up for sale in Court and listed with a realtor without the prior consent of ALL of the Trust beneficiaries is a grave concern.

As of March 07, 2012, Mr. Barnitt has failed in his fiduciary duties by failing to collect rent on the Trust’s real estate asset located at 8625 S. 12TH AVE, INGLEWOOD, CA 90305-2309 or to evict the occupant(s).

Mr. Barnitt’s failure to collect rent from the occupant(s) has resulted in the possible loss to the Trust in the amount of $1,800.00 per month at fair market value for twenty-two months [25 MONTHS x $1,800 = $45,000] thus far.

1. Why are no rent monies being collected on the Trust’s real estate asset located at 8625 S. Inglewood Ave and if rent monies were being collected by whom?

2. Why hadn’t the occupants been evicted?

3. Why were [are/have] the Trust real estate assets being offered for sale far below fair market value?

Real Estate Fraud, Justice to Plead Guilty

Michigan Supreme Court Justice Charged With Fraud

Published January 19, 2013
Associated Press

DETROIT –  Federal prosecutors have filed a fraud charge against Michigan Supreme Court Justice Diane Hathaway, just a few days before she leaves the state's highest court in a scandal involving the sale of a Detroit-area home and suspicious steps taken to conceal property in Florida.

The charge was filed Friday as a criminal "information," which means it was negotiated and that a guilty plea is expected in federal court. Defense attorney Steve Fishman declined to comment Saturday.

Hathaway is resigning Monday, months after a series of questionable real estate transactions first were revealed by a Detroit TV station. Hathaway and her husband, Michael Kingsley, deeded a Florida home to a relative while trying to negotiate a short sale on a house they couldn't afford in Grosse Pointe Park.

The sale went through and erased any remaining debt they had with the bank, $600,000. The debt-free Windermere, Fla., home then went back in their names.
