Felony Elder Abuse - Felony Elder Neglect
An Apopka High School employee has been arrested on a felony elder-abuse charge after her 80-something-year-old mother was found living in filth with nothing to eat, Apopka Police said.
Rhonda Lee Miller, 39, was already serving probation for felony charges of check fraud and grand theft when officers were called Saturday to the Crosby Motor Inn in Apopka, where Miller's mother had been living since December.

Russel Torralba, 41, was taken into custody by Canada Border Services Agency staff on Jan. 9 after a tip from the U.S. Marshals Service. At the time, he was working illegally as a nurse at a private home...
Last month, Torralba and co-defendant Alfredo Ruiz, 42, were charged with nine criminal counts each, including four felonies for elder neglect by a caregiver and one felony count of lewd act by a caregiver on a dependent adult.
Deputy District Attorney Paul Greenwood says video from 2011 shows the men engaging in repeated sex acts near a then-98-year-old woman they were caring for. In one instance, a nurse appears to place his crotch on the woman's hand.

A Welcome Emphasis On Elder Abuse
Examples of elder abuse in the headlines range from baffling to horrifying: from the lonely old widower conned out of his life savings by a pretty young woman to the invalid grandmother found restrained to her bed, covered in bedsores and filth.
Sadly, with the population growing grayer, elder abuse is on an upward curve. So it’s encouraging that many prosecutors — including Pierce County’s Mark Lindquist — are devoting more resources to the problem. His office got an additional $200,000 in the county’s 2014 budget to expand the Elder Fraud and Abuse team to include two deputy prosecutors and a legal assistant.
Prosecuting elder abuse has special challenges. As in child abuse and domestic violence cases, the victimizer is typically a family member, which can complicate prosecution if the victim is hesitant to testify. And many victims have some form of dementia, making them easy targets and often unreliable witnesses.
Too often, how Grandma is being treated is considered a private “family matter,” but that’s slowly changing as more people become aware of the signs of elder abuse.

What the judicial branch in our societies must do is stop treating elder abuse, financial elder abuse as civil matters, enforce as many criminal statutes regarding these types of crimes as possible and prosecute those that commit them.
Yep, if we don't speak up and speak out we are all just as guilty as those that commit these crimes.

Elder Abuse Doesn't Stall From One Year To Another
A woman who pleaded guilty Friday to stealing more than $500,000 from an elderly man with dementia and Alzheimer’s disease will be sentenced to three years of felony probation and is ordered to pay full restitution. Rosemary Baugh, 57, was charged with financial elder abuse and perjury, and faces 11 years and eight months in prison if she doesn’t comply with the terms of her plea deal.
Prosecutor Brian Cota explained after Friday’s hearing that while the probation sentence may seem somewhat lenient (considering the circumstances of the crime and the amount of money involved), the victim’s family and the District Attorney’s Office agreed it made legal and financial sense because a good portion of the stolen money is recoverable, lengthy and costly civil cases will be avoided, Baugh suffers from mental health problems, and the victim would likely not want to see her imprisoned. “Notwithstanding those issues,” Cota said, “this would have been a prison case.”

Police are crediting a Sandy-area insurance agent for interrupting financially devastating elder-abuse theft and are asking for help finding a person of interest in the case.
Lt. Robert Wurpes, Clackamas County Sheriff's Office spokesman, said the victim, an elderly widow, has learned that her bank accounts were drained and that an unauthorized reverse-mortgage line of credit was opened on her home. In addition, her car was repossessed and her credit card was overdrawn and canceled while her late husband's death-benefit account was wiped out.
"This kind of crime is aimed at the most vulnerable people," Wurpes said.
Wurpes said deputies want to question 79-year-old Viola E. Wharton's ex-daughter-in-law, Jacki Lynn Newman, 47, who lived in Wharton's home east of Sandy for six months before the insurance agent discovered the dwindling, muddled finances.
Wurpes said insurance agent Cody Giusto became suspicious earlier this year when he learned Wharton -- his neighbor -- had not paid her home-insurance premium and that her policy had been canceled. Giusto, 27, then tried to contact Wharton several times, but was brushed aside by Newman, who fed him a series of excuses.
But that only made Giusto more suspicious.

Elder abuse, including neglect, on the rise as world's population begins to age
[What is left in your wake once you become old, frail and helpless, when you or a loved one falls victim to elder abuse, financial elder abuse, fraud, undue influence and theft?]
"There is no gentle way to describe the state Cynthia was in when she arrived at the hospital.
Her chafed skin was covered in bedsores and feces. Her toenails were overgrown and curling, her right foot riddled with infections, and she had no teeth or dentures. She was dehydrated and malnourished, and couldn't speak.
Most troubling, her swollen right leg was 10 centimeters (4 inches) shorter than her left, the result of a fracture healing improperly.
Marguerite didn't ride to the hospital with her mother. Staffers called her repeatedly.
"I think we should discuss your mum," a social worker told Marguerite over the phone. "We are really concerned about her. She's not at all well."
Marguerite didn't show up to the hospital for three days.
So doctors called the state Adult Guardian to gain consent to operate. But the fracture was too severe and the delay in treatment too long; the break appeared between 3 and 12 weeks old.
On Dec. 30, the doctors recommended palliative care. Marguerite said no, then yes, then asked for her mother's transfer to another hospital. The doctors said Cynthia was too fragile.
Marguerite threatened to call the police if staffers touched her mother again. Hospital officials scheduled an urgent family meeting. Marguerite did not attend.
Cynthia died at 6:15 p.m. on Jan. 3, 2009. She was one week shy of her 89th birthday."
"The investigator, Det. Sgt. Glen Skugor, took the stand first. The case had bothered him, he said. It had bothered everyone — the paramedics, the doctors, his fellow officers.
The autopsy concluded Cynthia died from a blood clot in her lung, sparked by the leg fracture. In an expert opinion, Dr. Stephen Morrison, head of thoracic medicine at Royal Brisbane & Women's Hospital, said her condition suggested a "severe degree of neglect...to the point of cruelty in a distressed, demented and totally dependent patient."
Officers who photographed Cynthia's body noticed bruising on her arms and midsection. The police contemplated several charges: manslaughter, failure to provide the necessities of life, negligent acts causing harm, torture. But the doctors couldn't say beyond a reasonable doubt that Marguerite's care had directly caused Cynthia's death, and similar cases had failed to nab convictions.
And so police closed the case. No charges were filed. In the eyes of the law, Cynthia became a nonentity."
"People won't prosecute — whether it's police, whether it's family members — because it involves family business," she says.
"Because it's private. Because there's a level of abuse that's tolerated in the community that none of us wishes was there. We all turn a blind eye."

A holiday lesson: One young N.J. athlete's devotion to his sick mother
Over the past few months, with little feeling from the waist down and barely able to move, she developed potentially fatal bedsores. The wound on her sacral bone — the "butt bone" — is diagnosed as stage four, the most severe. She has more sores on her legs and hips.
Vitale, her doctor, says Vaida’s greatest danger is developing an infection. That means Quai’s most important job as her primary caregiver — cleaning and bandaging the wounds twice a day — is most crucial to Vaida’s survival.
"You can’t underestimate what taking care of those ulcers is doing for her," Vitale says. "Some people pass out by the smell. They pay nurses big money to do stuff like that."
Mother and son have an unbreakable connection: "God gave me a wonderful angel," Vaida Jefferson says. "œShe'™s truly my heart, my rock, my stone," Quai says. "Like, that'™s all I have."
The sores look like craters in her flesh, Quai says, with exposed bone, muscle and tissue. Wearing gloves and holding his breath, he removes the old dressings, gently cleans the wounds, applies prescription ointment and bandages them.
"You wouldn’t wish that upon your worst enemy," Quai says. "To see a loved one have to go through that is just dreadful."

Support legislation to allow for videocams
California State Senator Bob Huff is considering introducing a bill in California, like the recently enacted Oklahoma law, that would confirm the right to have videocams in residential care facilities (RCFEs) and skilled nursing facilities (SNFs) for people who want the protection it can provide. Sadly, while many facilities provide good care, there have been abuses and instances of very poor care. Having videocams that families can monitor and that facility management can use for monitoring and quality improvement would help eliminate these incidents.
What are the benefits of videocams? One good example is an RCFE named Vista Gardens Memory Care, in San Diego County in the town of Vista, which was built with cameras installed for the protection of the residents who want video monitoring. If there is any question about whether a staff person has misbehaved, Vista Gardens could find out if it occurred and correct it immediately. If a patient has bruises one morning, Vista Gardens could review the video recording to see that the bruises occurred, for example, when the patient fell out of bed reaching for a night table. The solution is to move the night table closer to the bed. If the resident is found on the floor with a bruise on the head, Vista Gardens could review the video of the resident falling and relay pertinent information to paramedics or the ER for treatment decisions. Also, if a hallucinating resident were to claim that something improper occurred (e.g., a lady claiming a naked man was in her room), Vista Gardens could review the video to ascertain that it did not happen.
Unfortunately, the California Department of Social Services’ Community Care Licensing Division (CCLD) and the Department Health Services (DHS), acting as a proxy for the California Association of Health Facilities (CAHF), have told Vista Gardens Memory Care that they may not conduct video recording in the rooms or allow anyone to conduct any video recording in the residents' rooms, even if the resident fervently wants the monitoring. CCLD and DHS have prohibited video cameras in Vista Gardens Memory Care, even though residents or the residents’ health care agents have given written consent for the video cameras and really want the video monitoring for their own protection. In addition, CCLD and DHS have prohibited the video cameras, even though there is no California law prohibiting video cameras in residents’ rooms, where there is a reasonable expectation of privacy only for the residents, who can waive their right to privacy to allow the video monitoring.
We believe that confirming the right to have videocam monitoring with the proper resident consents and privacy safeguards would greatly enhance protection for residents of nursing homes and RCFEs, and serve as a strong deterrent to harmful behavior.

RUSSELLVILLE — A Colbert County woman already in jail on traffic and drug-related charges now is accused of bilking several thousands of dollars from an elderly Russellville man, police said Friday.
Russellville Police Chief Chris Hargett said Jennifer Ann Lunsford, 41, 1565 Choctaw St., Cherokee, is charged with financial exploitation of an elderly person.

The holiday season offers a chance to reconnect with older family members and friends. Most reunions can be filled with joy. But some may leave you filled with concern.
If an elderly relative, friend or acquaintance doesn't look or act right, they may need help. There may be numerous causes for their condition, but in some cases you may have to think the unthinkable -- they may be a victim of elder abuse.
"If their physical appearance has changed in any way, if they've lost a lot of weight, seem somewhat more confused or something suddenly has changed in their financial circumstances, those types of things are red flags," says Donna Dougherty, attorney in charge of JASA's legal services for the elderly. JASA, an acronym for Jewish Association Serving the Aging, is a Manhattan-based, not-for-profit organization that provides social services, legal advice and nutrition services for seniors in the metropolitan area.

We filed two official complaints against the abusers
Before the abusers were deposed and testified, there were two official complaints lodged against them.
The first being days before Mr. Thelsey Leo Fuller was robbed and dump into a convalescent hospital against his will, denied his family that loved him, left alone to die... with the Los Angeles County Sheriff's Department, location and condition of Mr. Fuller.
Medical records indicate a serious problem, "Head's up... tip of the iceberg."
Multiple pressure ulcers, malnourished, dehydrated, anemic, low body mass, etc.
Diminished capacity, Pacific Palms, signed off by Robert L. Fuller.
Less than 30 days after Robert and his accomplices removed over $235,000.00 dollars from Mr. Thelsey L. Fuller's Citi/Wells bank accounts Mr. Thelsey S. Fuller (sic) was dead.
The second being with the York County Sheriff's Department after Mr. Thelsey L. Fuller died regarding veiled threats received by this author via US Mail from one of the abusers.

Elder Abuse Investigator Stole From Grandmother
Sanford social worker who investigated elder abuse accused of stealing from her grandmother
MOORHEAD – A Sanford Health employee whose job involved investigating and reporting elder abuse and neglect is accused of stealing about $20,000 from her own grandmother.
Alyse Ann Penner, 28, of Moorhead, was charged Tuesday in Clay County District Court with one felony count of exploitation of a vulnerable adult.

For over an entire year, Mr. Thelsey L. Fuller was never allowed to be asked or answer one question on the record regarding his wife - Mrs. Edwina J. Fuller, his desires, his children or his assets.
The fact that Thelsey L. Fuller and Odessa Gaines did not act as a married couple and instead maintained separate bedrooms over the entire course of their relationship is not part of any testimony.
But, instead the claims by Robert and Doris of a husband wife relationship between the pair. I suggest that they were roommates and very close friends that looked out for one another.

California Community Property Laws, Family Law section 760. “Except as otherwise provided by statute, all property, real or personal, wherever situated, acquired by a married person during the marriage while domiciled in this state is community property” and again, Probate Code Section 100-103 clearly provides that assets acquired during the course of a marriage are presumed to be community unless proven to be separate by the one claiming separate property."
It is not like our parents were married briefly, they were married for 72 years. The Court had within its power to immediately restrain the assets and by doing so would have protected the Conservatee and the Respondent from financial elder abuse.
Thelsey L. Fuller and Edwina J. Fuller were never divorced or legally separated and no evidence has been presented otherwise.
The lack of a restraining order left both parents vulnerable to elder abuse, financial elder abuse, fiduciary abuse, conspiracy, theft and fraud; which is exactly what took place.
Attorney Daniel k. Lak had refused to give the Conservatee, Edwina Fuller, Thelsey L. Fuller’s 92 year old widow, a copy of her husband’s Trust when requested in writing until so ordered by the Court. These actions are in direct violation of Probate Code Section 16061.7 and may be in violation of elder abuse laws under Welfare and Institutions Code, Section 15610.30 as well.
The Supreme Court has ruled and has reaffirmed the principle that "justice must satisfy the appearance of justice", Levine v. United States, 362 U.S. 610, 80 S.Ct. 1038 (1960), citing Offutt v. United States, 348 U.S. 11, 14, 75 S.Ct. 11, 13 (1954); again Courts have repeatedly held that positive proof of the partiality of a judge is not a requirement, only the appearance of partiality. Liljeberg v. Health Services Acquisition Corp., 486 U.S. 847, 108 S.Ct. 2194 (1988) (what matters is not the reality of bias or prejudice but its appearance); United States v. Balistrieri, 779 F.2d 1191 (7th Cir. 1985; (2) mitigate the damages caused by the Court by issuing a Court order to protect the remaining assets; (3) the Court has within its power to order funds that were removed before the Court could rule on them, be brought back and deposited with the Court along with any penalties; (4) issue an injunction that would prevent the further transfer of real property to another party until a ruling is made by the Court; and (5) launch an investigation into the improper actions of Attorney Daniel K. Lak, Robert L. Fuller, Doris A. Fuller Stewart.
