Sacramento elder care home operator accused of involuntary manslaughter


SACRAMENTO, CA - The operator of a Sacramento residential care home for the elderly was arrested on suspicion of involuntary manslaughter and elder abuse in the death of an 88-year-old woman in her care.

Law enforcement served an arrest warrant on 52-year-old Silvia Cata Monday evening. She is the administrator and caretaker at Super Care Home on Bowman Avenue.

According to an affidavit from state Attorney General's Office filed with Sacramento Superior Court, Cata cared for Georgia Holzmeister, who was diagnosed with dementia, for five years until her death in June, 2012. Holzmeister was brought to Sutter General Hospital's emergency room on June 19, 2012, with a deep, infected pressure wound on her tailbone.

Doctors also diagnosed her with sepsis, a toxic infection likely brought about by the pressure wound. Holzmeister was unconscious and after being discharged from the hospital the next day, was moved to a skilled nursing facility for comfort care. She died June 23, 2012.

The emergency room doctor who treated Holzmeister hospital said in the affidavit the pressure wound would have developed over weeks and was one of the worse he had ever seen.

Violation of CALIFORNIA PENAL CODE SECTION 368 {Criminal Elder Abuse}

PENAL CODE
§ 368(b)(1)(2)(3)

(Causes or permits infliction of physical pain or mental suffering on elder or dependent adult under circumstances or conditions likely to produce great bodily harm or death)

  • A person, under circumstances or conditions likely to produce great bodily harm or death, willfully causes or permits an elder or dependent adult to suffer
  • With knowledge that he or she is an elder or dependent adult
  • Unjustifiable physical pain or mental suffering
  • One year county jail and $6,000 fine or state prison two, three, or four years
  • If victim suffers great bodily injury - then additional state prison:
    • 3 years if victim under 70 years
    • 5 years if victim 70 years or older
  • If defendant causes death of victim - then additional state prison:
    • 5 years if victim under 70 years
    • 7 years if victim 70 years or older


PENAL CODE § 368(c)

  • A person, under circumstances or conditions other than those likely to produce great bodily harm or death, willfully causes or permits an elder or dependent adult to suffer

PENAL CODE § 368(d)
(Violates provision of law proscribing theft or embezzlement - not a caretaker)
  • A person, not a caretaker violates provision of law proscribing theft or embezzlement with respect to property or personal identifying information of an elder or dependent adult
  • With knowledge that he or she is an elder or dependent adult
  • When value of property taken exceeds $950:
  • One year county jail and $1,000 fine or state prison 2, 3 or 4 years
  • When value of property taken does not exceed $950:
  • One year county jail and $1,000 fine

(Violates provision of law proscribing theft or embezzlement - caretaker)
  • A caretaker violates provision of law proscribing theft or embezzlement with respect to property of an elder or dependent adult
  • When value of property taken exceeds $950:
  • Misdemeanor or felony: One year county jail and $1,000 fine or state prison 2, 3, or 4 years
  • When value of property taken does not exceed $950:
  • One year county jail and $1,000 fine

  1. The Fullers certainly seem to fall into the category of low hanging fruit; they couldn't be politically connected, could they? So it is a mystery why they are still free, especially with that conviction against them.

    Karma seems to have caught up with their accomplice/lawyer, that lak character--at least for the time being. When will karma catch up with the Fullers?

  3. Robert L. Fuller and his sibling, Doris A. Fuller a.k.a Doris Fuller Stewart are still at large.

    However, their former attorney Daniel Kristof Lak is currently dealing with a lot of negative karma [after helping the Fuller's commit elder abuse, financial elder abuse, fraud and undue influence] which is having an impact on his ability to practice law.

    All things considered it would appear that Kristof would be better served going after a singing career. Chicks dig him!

    It looks like Deadbeat Dan has made his youtube dating-search video private. Does this mean that prospective cinderellas won't be able to see what a chick magnate he is without the password?

    1. Daniel has certainly fell off. Who would hire him as an attorney after visiting his profile with the Bar?

      His former clients not so much, they are still thumbing their noses at the court and the court's orders. They have not suffered one iota.

  4. Yesterday I have found a Chichester based old age home. But we cannot call them a old age home as their home care, love and affection is given to elders. Their each and every need is respected there and the stuff has been organized for them keeping in mind their desires and specially the budget. They are given the complete independence and the compassionate home carers keep those old people in the fully comfortable atmosphere. Among other elder care agencies Chichester, they certainly are one among the best..
