Nursing Home Medicare Fraud $1.5B a Year, Says New U.S. HHS-OIG Report

Wealthy, highly profitable nursing homes in California and throughout the United States often cry poor, claiming that taxpayer-funded Medicare and Medicaid payments to facilities are not enough to ensure that they comply with staffing and quality-of-care laws. But a new study released this month by U.S. Department of Health and Human Services’ (HHS) Office of Inspector General (OIG) says that nursing homes ripped off $1.5 billion from U.S. taxpayers in just 2009 alone by submitting “inaccurate, medically unnecessary, and fraudulent claims” to Medicare.
The new HHS inspector general report is yet another report by a government agency, newspaper, or patients' rights advocacy organization on rampant nursing home elder abuse, falsified patient records, or Medicare fraud condoned by California Attorney General Kamala Harris’ Bureau of Medi-Cal Fraud and Elder Abuse (BMFEA) and the California Department of Public Health’s (CDPH) Licensing and Certification Program.

We reported in 2003 to the State of Calif's Dept of Justice, BMFEA division, that Sun Healthcare Group Inc had violated it's 2001 State Injunction not to have broken equipment in any of it's skilled nursing facilities again after killing patients in Burlingame, Calif in 2000, yet they did just that in 2003 in Newport Beach where even Sun's CEO and VP live. We even had the State's agency who govern HVAC systems out who condemned their HVAC, demanding Sun replace it IMMEDIATELY, NO EXCEPTIONS. Signed Chuck De Capite. The Medical Director who was also my mother's personal physician, Dr Stoney, testified in 2006 that the lack of the HVAC system killed my mother. Yet my corrupt attorney, Daniel Leipold, who threatened me in mediation for the CEO of Sun, Richard K Matros, neglected to get that Dr's testimony before advising me to settle for $17,000. I was incapicitated having had a pacreatic tumor surgery just weeks earlier,so when I recovered and was strong again I sued him 7 months later, he died 2 weeks after that in his sleep at age 59, obviously scared I'd have his law license revoked. I settled out of court with his malpractice insur co in 2008. However, in 2010 I requested copies of the Office of Statewide Facilities Planning & Dev. records and 3 pages I had kept from my lawsuit proving the equipment was condemned in June 2003 were missing. This proves the DOJ, who settled with Sun in Sept 2005 for $2.5 M for their violating the injunction in all of it's Calif facilities (except the Newport Beach Sun facility, Claude Vanderwald told us), commited a major fraud.
