Assisted Living Facility Shut Down, Patients Abandoned
Sheriff's deputies removed more than a dozen senior patients from a Northern California assisted living facility in Saturday after it was determined that they had been left "abandoned" there by the owners and staff.
The State Social Services shut down the Castro Valley facility onThursday, but 14 elderly residents were still there more than two days later, Alameda County Sheriff's Office said.
The Sheriff's Office was called Saturday afternoon to the facility on Apricot Street, which appears to be listed variously as Valley Springs Manor, Valley Manor Community Care Home or Valley Manor Residential Care, after a medical call, Sgt. J.D. Nelson said.
Responding paramedics became concerned after they found that most of the staff had left and only a skeleton crew remained, Nelson said.
Authorities said patients at the facility were left with only a cook, a janitor, and a caretaker for two days. The rest of the employees left after the state ordered the facility to be temporarily shutdown.
In addition, the state Department of Social Services had posted a notice on the door stating that the facility was to be closed on Oct. 24th, Nelson said. The sign on the front door read, "NOTICE: CLOSED FOR BUSINESS."
Nelson said the patients were elderly, some bedridden or in wheelchairs.

YORK, S.C. — A Rock Hill man in custody on charges that he killed his mother and a neighbor died in jail from head injuries, authorities said Monday.
An autopsy found that 34-year-old Joshua Grose died from blunt force trauma to the head, York County Coroner Sabrina Gast said.

On a bed in the foyer lay 88-year-old Cynthia Thoresen, her eyes screwed up in agony, her fists clenched, with a broken leg that had sat untended for weeks. Feces caked her body, from her arms down to her feet, filling the crevices between her toes and under her fingernails.

None knew that her daughter and caretaker, Marguerite Thoresen, had waited at least three weeks before calling for help, or that the help would come far too late.
In the end, Cynthia Thoresen joined a large and growing cohort of elderly people across the world who live — and increasingly die — in silence. They are unseen and unheard, left to fend for themselves against a problem society has barely begun to notice, let alone fix: elder abuse.
This type of abuse, which in many cases includes neglect, is still so hidden that it is hard to quantify. 2 women shot to death at Detroit senior center
DETROITA man who lives at a senior center in Detroit was in custody Sunday after, police said, he shot and killed two women he blamed for a breakup with his girlfriend.
The shooting happened after the 65-year-old man had an argument with his girlfriend that ended their relationship, police said in a news release. They said the man went to his apartment at the Pablo Davis Elder Living Center, got a rifle and started looking for two residents he believed responsible for breaking him and his girlfriend up.

Mickey Rooney's stepson settles Elder Abuse Lawsuit for millions
Mickey Rooney's stepson now concedes he owes the famed actor $2.8 million for allegedly siphoning off a ton of money from Mickey's financial accounts, but there's a GIGANTIC catch.
Christopher Aber and his wife, Christina, have just settled with Mickey's conservators, after allegations they played funny with Mickey's money. There were also allegations the couple deprived Mickey of food, meds, and even blocked him from leaving his home.
The whole thing escalated when the 93-year-old actor testified before Congress on elder abuse.
So now Christopher and Christina -- who have declared bankruptcy -- have folded.

Attorney Misappropriated $3.5 Million From Elderly Doctor
Judge: Attorney misappropriated $3.5 million from elderly doctor
A State Bar Court hearing judge has recommended disbarment for a San Francisco Bay Area attorney found to have committed what was the single largest misappropriation in the Office of Chief Trial Counsel’s recent memory.
State Bar Court Judge Lucy Armendariz found Wade Anthony Robertson culpable of four counts of misconduct for a phony investment scheme in which he misappropriated $3.5 million from an elderly man. The disbarment must be approved by the California Supreme Court before it goes into effect. Meanwhile, Armendariz ordered Robertson enrolled involuntarily inactive.
In her Sept. 4 decision, Judge Armendariz found Robertson [bar # 217899], 45, of Stanford, culpable of moral turpitude by engaging in a scheme to defraud, misrepresentation, misappropriation and of abusing the legal process. Armendariz also noted that Robertson has shown no remorse for his behavior, that he failed to admit any wrongdoing and that his misconduct occurred less than three years after he was admitted to practice law.

San Diego, CA: California is expected to pass three bills that will take a tougher stance on financial elder abuse than existing laws currently do. Those laws, which deal with elderly financial abuse, would not only update the definition of undue influence as it relates to elder abuse, but would also require notary publics to report suspected elder abuse.
According to Fox 5 San Diego (9/30/13), California Governor Jerry Brown has until October 12 to either sign or veto the proposed bills, which are designed to hold people more accountable for elder financial fraud. Among them are Assembly Bill 477, which would require notaries to notify authorities if they suspect elderly financial abuse is occurring, and Assembly Bill 140, which updates the definition of undue influence related to financial abuse.
In August 2013, Brown signed into law Assembly Bill 381, which allows the courts to award attorney’s costs and fees in situations where seniors are financially abused by people who have power of attorney.
The bills are likely welcome news for people concerned about how California’s seniors are treated, but it may come too late for some. In fact, regulators in California are accused of ignoring complaints of elder abuse. According to a report by the Center for Investigative Reporting (9/9/13; found online at cironline.org) in 2009, the California Department of Public Health told investigators to dismiss approximately 1,000 complaints of elder abuse and theft. This means almost 1,000 cases of elderly financial, physical and sexual abuse have been closed without a proper investigation, according to the Center for Investigative Reporting.
Much financial elder abuse is committed by trusted family members and associates, who are given power of attorney and have control of the senior’s money. Because financial elder abuse is often perpetrated by a family member, many seniors do not report it. Even if they do, because of their age, there is a chance they will have passed away before ever being compensated for their losses.

Casey Kasem's kids give stepmom Jean Kasem ultimatum to let them visit ailing father
The three eldest children of 'American Top 40' host Casey Kasem are threatening their stepmom Jean Kasem with legal action unless she lets them see their dad, who is in the advanced stages of Parkinson's disease.
Casey Kasem's three eldest kids are giving their stepmom until next week to change her tune about visits with their ailing, radio icon dad.
After that, they're taking legal action, daughter Kerri Kasem told the Daily News Thursday.
The kids from the "American Top 40" host's first marriage claim his current wife Jean Kasem has shut them out of their dad's life for the past three months.
They staged a public protest with picket signs outside his gated estate Tuesday, saying it's been three months since they've had contact with him.
Casey, 81, is suffering from advanced Parkinson's disease, and the kids are worried, Kerri said.
